I hereby state under penalty of perjury that I am authorized to act on behalf of Conair Corporation and all its subsidiaries (“Conair”). Conair is the global leader in the manufacture and distribution of personal care, grooming and health and beauty products. Part of Conair are the brands Conair, BaByliss, and many others. Legal entities which are subsidiaries or affiliates of Conair Corporation are BaByliss SARL, Conair Canada, Continental Conair Limited, Franzus Company, LLC, SalonQuest, LLC, Cuisinart, scunci International, Inc., Babyliss CoOperatief U.A., Allegro Mfg., Inc., Babyliss (UK) Limited, Waring Products, Inc., Conair Australia Pty., Ltd., C Co., Ltd. and RUSK Incorporated.
Conair and its subsidiaries are the exclusive owners of several Intellectual Property Rights (“IPRs”) in different countries, such as the design patents on the Babyliss Miracurl products (including US design patent USD717000S1, registered with the USPTO, Community design right , registered with EUIPO and Chinese patent right for design , registered with the State Intellectual Property Office of the PRC), as well as many other IPRs.
Any exploitation (including but not limited to the use) of Conair’s IPRs must be expressly authorized by my client.
The website operated under the domain name www.idealbeautyequipment.com, which is hosted on your server identified with IP address 127.0.0.1, contains products for sale which use Conair’s IPRs (see: http://www.idealbeautyequipment.com/product/Salon_beauty_equipment/566.html). I have a good faith belief that such use has not been authorized by Conair, its agents or the law, and the sale of these counterfeit Conair products constitutes design infringement.
You, as a hosting provider of this website, have been made aware of the infringing activity on the website operated under the domain name www.idealbeautyequipment.com, through this notification. On behalf of Conair, I hereby request you to remove the website expeditiously and permanently from your servers, or disable access to it in a swift and permanent manner within 5 days after receiving this letter.
In case you do not comply with these demands within the above deadline, Conair may take further legal action.
The information contained in this letter is accurate and shall not affect in any way, the rights, remedies and/or defenses my client has, had, or may have for acting in this matter.
